Home Bill Terms and Conditions

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE REGISTERING, BROWSING, DOWNLOADING, OR USING ANY HOME BILL PLATFORM. BY USING THE PLATFORM OR OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING ANY FUTURE MODIFICATIONS. IF YOU DO NOT AGREE, YOU MAY REFRAIN FROM USING THE PLATFORM.

These Terms and Conditions (as amended from time to time) constitute a legal contract between you, an individual customer, member, user, or beneficiary of this service of at least 18 years of age (“You”), and Home Bill Corporation Private Limited (together with its subsidiaries and affiliates, “Us,” “We,” “Home Bill”).

Home Bill operates on multiple platforms, including WhatsApp, Messenger, Telegram, mobile apps, web apps, and websites (collectively referred to as “Home Bill Platforms“). Home Bill reserves the right, at its sole discretion, to revise, add, or delete portions of these terms and conditions any time without further notice which shall be your responsibility to visit from time to time inorder to stay abreast of any changes that the “Site” may introduce. The services hereunder are offered by Home Bill Corporation (Private) Ltd, located at: 82 Rezende Street, 605 Equity House Harare, Zimbabwe

  1. Eligibility

1.1 Age Requirement
To register, use, or access any services provided through Home Bill Platforms, you must be at least 18 years of age or the legal age of majority in your jurisdiction, whichever is higher. If you are under the required age, you must not use Home Bill’s services or register an account on the platform. By using the Home Bill Platforms, you confirm that you meet the eligibility requirements and have the legal capacity to enter into this agreement.

1.2 Legal Authority
You represent and warrant that you have the full legal authority to enter into these Terms and Conditions. If you are using the Home Bill Platforms on behalf of an organization, company, or other legal entity, you represent and warrant that you have the necessary authority to bind the entity to these Terms and Conditions.

1.3 Registration Information
When registering for an account or using any service, you agree to provide accurate, complete, and up-to-date information. This includes, but is not limited to, your name, email address, phone number, date of birth, and any other necessary details for the registration process. You must ensure that this information remains current and accurate at all times.

1.4 Account Ownership
You are solely responsible for the activity that occurs under your account, including any content, payments, or actions associated with your account. You agree to immediately notify Home Bill of any unauthorized use of your account or security breach. Home Bill is not responsible for any losses incurred as a result of unauthorized access to your account due to your failure to maintain the security of your login information.

1.5 Prohibition of Unauthorized Access
If you are under the age of 18 or otherwise unable to comply with these Terms and Conditions, you are prohibited from accessing or using Home Bill’s services. If it is discovered that you are ineligible, Home Bill reserves the right to immediately terminate your account and access to the platform, and take appropriate legal action if necessary.

1.6 Country-Specific Restrictions
Home Bill’s services may not be available in all countries or jurisdictions. You are solely responsible for ensuring that your use of Home Bill complies with local laws and regulations. Home Bill reserves the right to restrict access to the platform in certain jurisdictions, and will not be held liable for any legal issues arising from use of the platform in restricted regions.

1.7 No Proxy Use
You must not use the platform on behalf of someone else or impersonate another individual without proper authorization. All users must provide accurate personal information and must not act as a proxy for other individuals who are ineligible or prohibited from using the platform.

1.8 Right to Refuse Service
Home Bill reserves the right to refuse service to any individual or entity at its sole discretion, without providing reasons, particularly in cases where the individual does not meet eligibility requirements or has engaged in prohibited activities.

1.9 Compliance with Terms
By accessing or using the Home Bill Platforms, you confirm that you meet the eligibility criteria set out in these Terms and Conditions, and agree to comply with all applicable laws and regulations governing your use of the platform. Home Bill may verify your eligibility, and you agree to cooperate with such verification processes.

1.10 Minors and Parental Consent
If you are under 18 years of age but over the minimum age required to consent to data processing in your jurisdiction, you may use Home Bill’s services only with the consent of a parent or guardian. If Home Bill learns that a user under the age of 18 has provided false registration information or used the platform without parental consent, we may suspend or terminate the account and take necessary actions in accordance with applicable laws.

2. About Home Bill

2.1 Overview
Home Bill is a digital platform that resells prepaid mobile services and electronic vouchers through partnerships with telecommunications service providers (“Telcos”) and other distributors or aggregators. It simplifies the process of purchasing and managing mobile recharge, digital products, and services for users.

2.2 Prepaid Mobile Services
Home Bill serves as a reseller of prepaid mobile recharge services provided by Telcos. This includes airtime, data bundles, and other mobile services. We facilitate the purchase of recharge products, but Home Bill is not a warrantor, insurer, or guarantor of the services provided by the Telcos. Any issues related to service quality, terms, minutes, cost, or expiration must be resolved directly between you (or the recipient) and the Telco.

2.3 Electronic Vouchers
In addition to mobile recharge services, Home Bill offers a wide range of electronic vouchers, including gift cards, entertainment subscriptions, and utility payments. These products are also sold without recourse against Home Bill for any service-related disputes.

3. Account Registration and Security

3.1. Account Creation and Registration

3.1.1. To use Home Bill Platforms, you must create an account by providing accurate and complete personal details, including but not limited to your full name, contact information, payment details, and other required information.
3.1.2. By registering, you agree to provide truthful, up-to-date, and accurate information and to promptly update it if any changes occur.
3.1.3. You must create a unique user ID and password for your account and ensure that these credentials are kept confidential and secure.
3.1.4. Home Bill reserves the right to reject any registration request or suspend an account at any time for non-compliance with these registration requirements.

3.2. Account Security and Responsibility

3.2.1. You are solely responsible for maintaining the confidentiality of your account credentials, including your user ID, password, and any other security details provided to you by Home Bill.
3.2.2. You must immediately notify Home Bill of any suspected unauthorized access to your account or any security breach, such as the loss, theft, or exposure of your account information.
3.2.3. You are fully responsible for any activities that occur under your account, including any transactions, regardless of whether you authorized them. This includes any losses or damages resulting from unauthorized use or access to your account.
3.2.4. You should take all necessary measures to protect your login information from being disclosed or accessed by unauthorized individuals. This may include, but is not limited to:

  • Using a strong password
  • Enabling two-factor authentication (2FA), if available
  • Avoiding sharing your login credentials with others
  • Ensuring you log out of your account after each session
    3.2.5. Home Bill is not liable for any unauthorized access or loss of data resulting from a failure on your part to protect your account credentials or for actions taken by third parties using your account information.

3.3. Password Recovery and Account Lockout

3.3.1. If you forget your password, Home Bill provides a password recovery process. You will need to follow the steps provided to reset your password, including verifying your identity through the email or phone number linked to your account.
3.3.2. For your protection, Home Bill may implement account lockout mechanisms to prevent unauthorized access after a certain number of incorrect login attempts.
3.3.3. If your account is locked due to security concerns, you will need to contact Home Bill’s support team to unlock the account and follow the required verification procedures.

3.4. Verification of Identity

3.4.1. Home Bill may, at any time, request that you verify your identity to ensure that your account is secure and that you are the legitimate user.
3.4.2. This verification process may include providing government-issued identification (e.g., passport, national ID), proof of address, or other documentation.
3.4.3. If you do not provide the requested verification documents within a reasonable timeframe, Home Bill may restrict or suspend access to your account until the verification is completed successfully.

3.5. Account Termination and Suspension

3.5.1. Home Bill may suspend or terminate your account immediately, without notice, if we suspect or detect any suspicious activity, including but not limited to:

  • Fraudulent transactions or use of stolen payment details
  • Failure to provide accurate and complete information during registration or verification
  • Violations of the Home Bill Terms and Conditions
  • Breach of security protocols, such as account compromise
    3.5.2. In the event of an account suspension or termination, you will lose access to certain features, services, and funds associated with your account.
    3.5.3. If your account is suspended or terminated, you may contact Home Bill’s customer support team to appeal or resolve the matter, provided you can provide sufficient evidence of your compliance with the Terms and Conditions.

3.6. Data Privacy and Protection

3.6.1. Home Bill will handle your personal information in compliance with applicable data protection laws. Your personal information will be used exclusively for the purpose of providing services to you, enhancing platform functionality, and meeting legal requirements.
3.6.2. You acknowledge that Home Bill may collect and process certain personal information, including payment details, for security and fraud prevention purposes.
3.6.3. Home Bill will make every reasonable effort to protect your personal data from unauthorized access, loss, or misuse. However, Home Bill does not guarantee the absolute security of your data, as no system is completely immune to external threats.

3.7. Security Measures and Home Bill’s Liability

3.7.1. Home Bill will implement security measures to protect your account, such as encryption, secure sockets layer (SSL) technology, and two-factor authentication (2FA) to mitigate risks associated with unauthorized access.
3.7.2. However, Home Bill does not guarantee that these measures will completely prevent all potential threats. You are also responsible for maintaining the security of your device, network, and internet connection to avoid unauthorized access to your account.
3.7.3. Home Bill is not liable for any losses or damages arising from breaches of security, provided that we have taken reasonable steps to protect your account and personal information.

4. Prohibited Conduct

By using Home Bill Platforms, you agree not to engage in any of the following prohibited conduct. These actions may result in the suspension or termination of your account, and may also lead to legal action where appropriate. This list is not exhaustive, and Home Bill reserves the right to take action against any behavior it deems harmful to its services, users, or business operations.

4.1. Impersonation and Misrepresentation

  • You may not impersonate any person or entity, or falsely represent your affiliation with any individual, organization, or company.
  • You may not use false or misleading information in any communications with Home Bill or third parties through the platform.
  • You are prohibited from creating an account on behalf of someone else without their explicit consent.

4.2. Fraudulent Activities

  • You may not engage in fraudulent activities, including but not limited to:
    • Using stolen or unauthorized credit cards, payment methods, or financial information to purchase services or products.
    • Participating in any form of payment fraud, such as chargebacks or falsely disputing legitimate transactions.
    • Using deceptive tactics to manipulate platform or financial services.

4.3. Violation of Intellectual Property Rights

  • You may not distribute, reproduce, or otherwise use any intellectual property, including logos, trademarks, and copyrighted content, owned by Home Bill or third parties without proper authorization.
  • You are prohibited from uploading, sharing, or transmitting content that infringes upon the intellectual property rights of others.

4.4. Defamatory, Abusive, or Offensive Content

  • You may not use Home Bill Platforms to transmit, upload, or otherwise share any content that is:
    • Defamatory, offensive, harmful, or hateful in nature.
    • Threatening, abusive, harassing, or discriminatory against individuals or groups.
    • Pornographic, obscene, or otherwise inappropriate.

4.5. Illegal Activities

  • You are prohibited from using Home Bill Platforms for any illegal purpose or to conduct any activity that violates the laws and regulations of the jurisdiction in which you operate.
  • You may not use the platform to engage in money laundering, terrorism financing, or other illegal financial activities.
  • Any attempt to exploit Home Bill services for illegal purposes will result in immediate account termination and possible legal action.

4.6. Interference with Platform Operations

  • You may not engage in any activity that interferes with or disrupts the normal functioning of Home Bill Platforms. This includes but is not limited to:
    • Attempting to overload or disrupt the server infrastructure.
    • Introducing viruses, malware, or any other harmful software that could damage, disable, or interfere with the platform.
    • Engaging in denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks.

4.7. Reverse Engineering and Unauthorized Access

  • You may not attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to gain unauthorized access to any part of Home Bill’s software or systems.
  • You are prohibited from attempting to bypass any security measures or protocols implemented by Home Bill to protect the platform and user data.
  • You may not engage in any activities aimed at finding vulnerabilities in Home Bill systems or software, except for authorized security testing.

4.8. Spam and Unauthorized Communication

  • You may not use Home Bill Platforms to send spam or unsolicited communications, including email or messages, to other users or third parties.
  • You are prohibited from using automated scripts or bots to interact with Home Bill Platforms for mass communication or data collection.

4.9. Data Collection and Harvesting

  • You may not engage in unauthorized data collection practices such as scraping, harvesting, or gathering data from Home Bill Platforms for commercial or unauthorized purposes.
  • You are prohibited from using Home Bill Platforms to collect personally identifiable information (PII) of other users without their consent.

4.10. Reselling Services

  • You may not resell or redistribute Home Bill services without explicit permission from Home Bill.
  • You are prohibited from using Home Bill’s platform for activities that promote, sell, or distribute Home Bill services through unauthorized channels or to unauthorized third parties.

4.11. Violation of Privacy

  • You may not collect, store, or share personal data of other users of Home Bill without their express consent.
  • You are prohibited from engaging in any activities that compromise the privacy of Home Bill’s users, including sharing their personal information without authorization.

4.12. Using Home Bill for Harmful Activities

  • You may not use Home Bill Platforms for any activity that may harm, damage, or otherwise negatively impact Home Bill’s reputation, users, or third parties.
  • Any use of Home Bill for the promotion of violence, hate speech, or discrimination is strictly prohibited.

4.13. Bypassing Terms and Conditions

  • You may not use any method or tool to circumvent or bypass these Terms and Conditions, including using multiple accounts or engaging in any actions that would violate Home Bill’s fair use policies.

4.14. Unlawful Financial Transactions

  • You may not engage in transactions that violate Home Bill’s policies regarding payment processing, including using funds for money laundering, fraudulent investments, or other illicit activities.
  • You are prohibited from using Home Bill Platforms for gambling, betting, or any other unlawful financial operations.

4.15. Misuse of Customer Support

  • You may not engage in abusive behavior towards Home Bill staff or support teams, including making threats, using offensive language, or creating false reports.
  • Attempts to exploit or manipulate customer support for personal gain or malicious purposes will not be tolerated.

4.16. Harassment or Intimidation

  • You may not harass, intimidate, or otherwise attempt to coerce other users into providing personal information, services, or any other items of value.
  • Engaging in bullying or threatening behavior will result in immediate suspension of services.

4.17. Consequences of Prohibited Conduct

  • Any violation of these prohibited conduct terms can result in immediate suspension or termination of your account, without prior notice.
  • Home Bill reserves the right to take legal action if necessary, including reporting violations to the appropriate authorities.
  • You agree to cooperate fully with any investigation or legal process involving Home Bill’s services.

5. Third-Party Services and Links

5.1. Third-Party Services
Home Bill Platforms may contain links to external websites, services, or resources (“Third-Party Services”) that are not operated or controlled by Home Bill. These Third-Party Services may include, but are not limited to:

  • Telecommunications providers (Telcos)
  • Payment processors
  • Content providers
  • Advertising services
  • External product or service offers

5.2. No Endorsement or Responsibility
Home Bill does not endorse or make any representations regarding the quality, accuracy, legality, or completeness of any Third-Party Services. These Third-Party Services are not under Home Bill’s control, and Home Bill shall not be held responsible for the availability, content, or functionality of any Third-Party Services linked to or accessed via the Home Bill Platforms.

5.3. User’s Responsibility for Third-Party Services
By using Home Bill Platforms, you acknowledge and agree that:

  • Any dealings with third parties, including the purchase of goods, services, or subscriptions, are solely between you and the third party.
  • Home Bill is not responsible for any loss, damage, or inconvenience caused by the use of or reliance on Third-Party Services.
  • Any disputes or claims related to Third-Party Services must be resolved directly with the third party, and Home Bill shall not be held liable for such disputes.
  • Home Bill does not control the content, terms, or privacy policies of third-party websites or services, and you access them at your own risk.

5.4. Third-Party Advertisements
Home Bill may also display advertisements or promotions from third-party advertisers (“Third-Party Advertisements”) through various channels, including but not limited to in-app ads, email campaigns, or website banners. These advertisements are provided by external advertisers and may link to their respective websites or services.

5.4.1. Advertising Relationships

  • Home Bill does not have control over the content of these Third-Party Advertisements and is not responsible for the accuracy or legality of the advertising materials presented by third parties.
  • Your interaction with Third-Party Advertisements is governed by the terms and conditions of the third-party advertisers, and you are solely responsible for any transactions, purchases, or disputes that may arise as a result of your interaction with such advertisements.

5.4.2. Data Collection by Advertisers

  • Advertisers may use tracking technologies such as cookies, web beacons, or similar technologies to collect information about your interaction with their advertisements.
  • Home Bill does not have access to this data and is not responsible for how third-party advertisers collect or use your personal information.

5.5. Links to Third-Party Websites
Home Bill Platforms may contain links to external websites or resources not operated by Home Bill. These links are provided for your convenience or reference only and are not an endorsement of the linked websites or their contents.

5.5.1. Accessing Third-Party Websites

  • When you click on a third-party link, you leave Home Bill Platforms and are subject to the terms of use, privacy policies, and practices of the third-party website you visit.
  • Home Bill is not responsible for any content or materials on third-party websites, and we do not have control over their privacy practices. You should review the privacy policy and terms of use of any third-party website before disclosing any personal information.

5.6. Availability of Third-Party Services
Home Bill does not guarantee the continued availability of any Third-Party Services linked through the Home Bill Platforms. Third-Party Services may be temporarily or permanently unavailable, or their content, terms, or pricing may change without prior notice. Home Bill is not responsible for any loss or inconvenience caused by such changes or unavailability.

5.7. Disclaimers Regarding Third-Party Services

  • No Warranty: Home Bill does not warrant that any Third-Party Services are accurate, complete, secure, or free from errors.
  • Security Risks: Home Bill does not guarantee the safety or security of Third-Party Services and is not responsible for any potential security risks you may face when interacting with third-party websites or services.
  • Liability: Home Bill shall not be liable for any losses, damages, claims, or expenses resulting from your use of any Third-Party Services, including those accessed via links, advertisements, or promotions.

5.8. Modification or Removal of Links
Home Bill reserves the right to modify, update, or remove links to Third-Party Services at any time, without notice. These actions may be taken for reasons such as changes in business relationships, service availability, or for compliance with applicable laws or regulations.

6. Termination and Violations

6.1. Termination of Account by Home Bill
Home Bill reserves the right to suspend, restrict, or terminate your account or access to the Home Bill Platforms, at its sole discretion, without prior notice, if any of the following occurs:

  • Violation of Terms: If you violate or breach any of the provisions outlined in these Terms and Conditions, including but not limited to unauthorized or prohibited conduct as defined in Section 4.
  • Fraudulent Activity: Engaging in any form of fraudulent activity, including the use of stolen payment methods, fraudulent transactions, or the intentional provision of false or misleading information.
  • Abusive or Harmful Behavior: Engaging in behavior that is abusive, harmful, offensive, or discriminatory to other users, employees, or agents of Home Bill.
  • Unauthorized Reselling: If you attempt to resell or redistribute Home Bill services without the explicit written consent of Home Bill.
  • Failure to Pay: If you fail to settle any outstanding balances, fees, or charges for services provided by Home Bill.
  • Risk of Harm: If Home Bill believes, in its sole discretion, that your continued use of the Platform poses a risk to the security, functionality, or reputation of the platform, or violates the safety of its other users or the platform itself.

6.2. Account Suspension
In cases where Home Bill detects suspicious activity or a potential violation of these Terms and Conditions, we may temporarily suspend your account until the matter is investigated. During the suspension, you will not be able to access certain services, and you may be asked to provide clarification or cooperate with the investigation. If a violation is determined, further action may be taken, including permanent termination.

6.3. Termination by User
You may terminate your account at any time by submitting a request to Home Bill’s customer support, following the proper account deactivation process. Once you request termination:

  • You will lose access to all services provided by Home Bill.
  • You will still be liable for any outstanding fees or balances that remain on your account.
  • Termination does not relieve you of your obligations or responsibilities under these Terms and Conditions, including any payment obligations or other liabilities arising prior to termination.

6.4. Consequences of Termination
Upon the suspension or termination of your account, the following may occur:

  • Loss of Access: You will immediately lose access to your account, including any data, services, or credits associated with it.
  • Remaining Obligations: You will remain responsible for all outstanding fees or charges that were incurred up to the date of suspension or termination.
  • Forfeiture of Data: All data associated with your account, including transaction history, personal information, and preferences, may be permanently deleted. Home Bill is not responsible for retaining any such data after termination.
  • No Refunds: Termination of your account will not entitle you to any refunds for services already rendered, including any prepaid balances or unused services.

6.5. Prohibited Actions Leading to Violations
In addition to the actions mentioned in Section 4 (Prohibited Conduct), the following activities are also considered violations and may result in termination or suspension:

  • Account Misuse: Using another person’s account or allowing someone else to access your account without authorization.
  • Sharing Sensitive Information: Sharing or distributing sensitive or confidential account information (such as passwords, account numbers, or security PINs) in an insecure manner or without proper authorization.
  • Impersonation or Fraud: Engaging in identity theft or impersonating another person, including Home Bill employees or other users.
  • Harassment: Engaging in harassment or discrimination against other users or employees, either online or through the platform.
  • Failure to Cooperate: Refusing or failing to cooperate with any investigation or request made by Home Bill in the event of suspected violations of these Terms and Conditions.

6.6. Notice of Violation
If Home Bill determines that you have violated any of these Terms and Conditions, Home Bill may provide you with a notice of violation outlining the nature of the breach and the required actions for remediation. You may be given a reasonable period of time to remedy the violation or explain your actions. If no resolution is reached or the violation persists, further action, including suspension or termination, may be taken.

6.7. Reporting Violations
If you encounter any violations of these Terms and Conditions, or suspect that another user is engaging in fraudulent or abusive behavior, you should promptly report it to Home Bill customer support. You may contact us through our website, email, or other communication channels, providing relevant details and evidence, if possible. Home Bill will review the report and take appropriate actions, which may include suspension, restriction, or termination of the offending account.

6.8. Right to Change and Modify Terms
Home Bill reserves the right to modify or update these Terms and Conditions at any time. In such cases, you will be notified of any significant changes that may affect your rights or obligations under these Terms. Continued use of the Home Bill Platforms after any changes are made to these Terms will be deemed as your acceptance of those changes.

6.9. Retention of Rights
Termination or suspension of your account does not affect any of the rights or obligations that arose before such termination or suspension. Home Bill retains the right to enforce legal actions or remedies in relation to any breach that occurred prior to account termination.

7. Limitation of Liability

7.1 No Liability for Indirect, Incidental, or Consequential Damages
Home Bill, its affiliates, directors, employees, agents, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to:

  • Loss of profits
  • Loss of business opportunities
  • Loss of data or personal information
  • Damage to reputation or goodwill
  • Service interruptions, delays, or errors
  • Inability to use services or products

Even if Home Bill has been advised of the possibility of such damages, Home Bill’s total liability will not exceed the actual direct damages incurred.

7.2 Limitations on Claims
The maximum liability of Home Bill, in relation to any claim or dispute, whether in contract, tort, or otherwise, is limited to the amount you paid for the Home Bill service or product that gave rise to the claim, whichever is lower. This limitation applies to any claim, action, or cause of action, regardless of the form of the action, whether based on breach of contract, breach of warranty, tort (including negligence), or any other legal theory.

7.3 No Responsibility for Third-Party Services
Home Bill is not responsible or liable for any third-party services that are offered or accessed via the Home Bill Platforms, including but not limited to telecommunications services, payment processors, voucher services, or any other third-party providers linked to or integrated with Home Bill. Any issues arising from your use of third-party services are solely between you and the third-party provider. Home Bill has no control over these third-party services, and we disclaim all warranties, representations, or guarantees regarding the quality, availability, or accuracy of these services.

7.4 Force Majeure
Home Bill shall not be held liable for any failure or delay in performance under these Terms and Conditions if the failure or delay is caused by circumstances beyond our control. These include but are not limited to:

  • Natural disasters (e.g., earthquakes, floods, fires)
  • Wars, terrorism, or civil unrest
  • Governmental actions or regulations
  • Labor strikes or work stoppages
  • Acts of God or other unforeseeable events
  • Internet failures, technical issues, or network outages
    In such cases, Home Bill’s obligations will be suspended for the duration of the force majeure event.

7.5 No Guarantee of Service Availability
Home Bill does not guarantee that the Home Bill Platforms will be available without interruptions. While we strive to provide uninterrupted services, we cannot guarantee that the Platform will be available at all times, and we shall not be liable for any temporary or permanent interruption, suspension, or cessation of services. This includes interruptions due to system maintenance, upgrades, network outages, or any other technical issues.

7.6 No Warranty on Information Accuracy
While Home Bill makes every reasonable effort to ensure that the information provided on the Platform is accurate, complete, and up-to-date, we do not guarantee the accuracy, completeness, or timeliness of any information, including but not limited to pricing, availability, and product descriptions. Home Bill is not liable for any damages or losses resulting from inaccurate, incomplete, or outdated information provided on the Platform.

7.7 Exclusion of Warranties
Home Bill provides the Home Bill Platforms and services on an “as is” and “as available” basis. To the fullest extent permitted by law, Home Bill disclaims all warranties, express or implied, including but not limited to:

  • The warranties of merchantability or fitness for a particular purpose
  • The warranties of title or non-infringement
  • Warranties regarding the reliability, accuracy, or completeness of the Home Bill Platforms or its content

Home Bill does not warrant that the Platform will meet your requirements or that any errors or defects will be corrected.

7.8 Exclusion of Liability for User Content
Home Bill is not responsible for user-generated content on the Platform. This includes content submitted by you or other users. Home Bill disclaims all liability for any loss, damage, or harm caused by such content, including but not limited to content that is offensive, defamatory, harmful, or in violation of any laws. You are solely responsible for the content you post or submit.

7.9 Exclusion of Liability for Viruses or Malware
Home Bill is not responsible for any viruses, malware, or other harmful software that may be transmitted through the use of the Home Bill Platforms. While Home Bill takes reasonable precautions to protect the Platform, it is your responsibility to take necessary precautions, such as using antivirus software and firewalls, to protect your own devices.

7.10 No Liability for Loss of Data
Home Bill is not liable for any loss of data, including any personal data, payment information, or transaction details. We recommend that you back up important information regularly. Home Bill cannot guarantee that data stored on the Platform will not be lost or corrupted during transmission or storage.

7.11 Exclusive Remedy
In the event of a dispute or claim, your exclusive remedy is to discontinue use of the Home Bill Platforms. No other remedies or compensation will be provided for any damage, loss, or harm resulting from the use of the Platform or services.

By using Home Bill Platforms, you acknowledge and agree to these limitations of liability and understand that the risks of using the services are your responsibility.

8. Indemnification

8.1 General Indemnification
You agree to indemnify, defend, and hold harmless Home Bill, its subsidiaries, affiliates, officers, directors, employees, agents, representatives, and licensors (collectively, “Indemnified Parties”) from and against any claims, actions, demands, liabilities, damages, losses, expenses, and costs (including reasonable legal fees and costs) arising out of or related to:

8.1.1 Your use or misuse of the Home Bill Platforms and services;
8.1.2 Your violation of these Terms and Conditions, including any breach of your representations and warranties;
8.1.3 Your violation of any applicable law, regulation, or third-party rights, including intellectual property rights;
8.1.4 Any content that you upload, post, transmit, or make available on Home Bill Platforms, including any infringement of third-party intellectual property rights;
8.1.5 Your failure to comply with any applicable local, national, or international laws;
8.1.6 Any dispute between you and other users or third parties arising from your use of Home Bill services;
8.1.7 Any fraudulent, deceptive, or unlawful act committed by you, including but not limited to providing false or misleading information or engaging in fraudulent transactions;
8.1.8 Any claims related to data breaches, security incidents, or misuse of your account arising from your failure to properly protect your login credentials, PIN, or other account information.

8.2 Defense of Claims
In the event of any claim, demand, or action against the Indemnified Parties, Home Bill will promptly notify you in writing of the claim. You shall cooperate fully in the defense of such claims, at your own expense, and will be responsible for any legal costs incurred. Home Bill reserves the right to assume the exclusive defense and control of any matter subject to indemnification, at your expense. If Home Bill chooses to assume defense, you shall cooperate and provide all necessary assistance in defending the claim.

8.3 Exclusions from Indemnification
Home Bill will not be responsible for indemnification in the following cases:
8.3.1 If the claim arises from Home Bill’s own gross negligence or willful misconduct.
8.3.2 If the claim results from a defect or failure in the Home Bill Platforms or services that is directly attributable to Home Bill’s failure to perform its obligations under these Terms and Conditions.
8.3.3 If the claim arises solely from Home Bill’s failure to adhere to applicable laws or regulations governing its services.

8.4 Consequences of Indemnification
8.4.1 Failure to Comply: If you fail to defend or cooperate in the defense of any claim, Home Bill may defend the claim at your expense and hold you responsible for all legal and associated costs.
8.4.2 Continuing Liability: Indemnification obligations shall survive the termination or expiration of these Terms and Conditions or your use of Home Bill services.
8.4.3 Recovery of Costs: If Home Bill is required to pay any amounts as part of a claim, you agree to promptly reimburse Home Bill for those costs, including any legal fees, settlement costs, or damages paid to the claimant.

8.5 Limitations of Liability
Notwithstanding anything to the contrary in these Terms and Conditions, the indemnification obligations set forth in this section shall be limited to the full extent permitted by applicable law, and Home Bill is not liable for any damages, loss of profits, or punitive damages resulting from claims or disputes, except in cases of gross negligence or willful misconduct.

8.6 Cooperation with Regulatory Authorities
If any indemnification obligation arises in connection with an investigation or legal proceeding initiated by a regulatory or governmental authority, you agree to cooperate fully with the investigation, and assist Home Bill in responding to such investigations, subpoenas, or regulatory inquiries. Home Bill shall provide you with timely updates on any such investigation that may require your cooperation.

9. Disclaimer of Warranties

9.1. No Warranty for Service Availability
Home Bill does not guarantee that the Home Bill Platforms will be available at all times or that access to them will be uninterrupted or error-free. Service interruptions, downtime, or maintenance may occur, and Home Bill will not be responsible for any consequences resulting from such disruptions. We do not warrant that any defects in the service will be corrected or that the platform will meet your expectations.

9.2. No Warranty for Third-Party Services
Home Bill platforms may link to or provide access to third-party services, including telecommunications companies (Telcos), payment processors, and digital voucher providers. Home Bill does not guarantee the quality, functionality, or performance of any third-party services or content. Any issues or disputes arising from interactions with third-party services, including performance failures, inaccuracies, or service interruptions, are the responsibility of the respective third-party providers. Home Bill will not be held liable for such third-party issues.

9.3. “As-Is” Basis
The services provided by Home Bill are delivered “as-is” and “as-available.” To the fullest extent permitted by applicable law, Home Bill disclaims all representations, warranties, and conditions, whether express, implied, or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, or the accuracy, completeness, or reliability of any content provided through the platform.

9.4. No Warranty for User-Generated Content
Home Bill is not responsible for any user-generated content or interactions between users within the platform. We do not warrant the accuracy, legality, or safety of any content posted by users and are not responsible for any harm or damages resulting from user-generated content, communications, or interactions.

9.5. No Warranty for Security or Data Integrity
While Home Bill employs reasonable efforts to secure the platform and protect the data you provide, we do not warrant that your personal or financial data will be completely secure from unauthorized access, loss, alteration, or theft. You acknowledge that the transmission of data over the internet is inherently vulnerable to security breaches, and Home Bill cannot guarantee absolute security.

9.6. Limitation of Warranty on Product Availability
Home Bill does not guarantee that any product, service, or digital voucher offered via the platform will be available at any given time. Products or services may be discontinued, unavailable, or out of stock without notice. Home Bill makes no warranty as to the availability, timeliness, or pricing of products or services offered through the platform.

9.7. No Warranty for Transactions
Transactions made via the Home Bill platform, including the purchase of recharge services, digital vouchers, or any other services, are subject to the terms and conditions of the relevant third-party service providers. Home Bill is not responsible for any failure in processing payments, errors in transaction processing, or issues arising from the payment gateway, including but not limited to failed or incorrect transactions, chargebacks, or refund disputes.

9.8. No Warranty for Compliance with Laws
Home Bill does not warrant that the use of the platform or its services will comply with the laws or regulations of any particular jurisdiction. You are solely responsible for ensuring that your use of Home Bill services complies with all applicable laws, including those related to consumer protection, taxes, intellectual property, and data protection.

9.9. No Warranty for Accuracy or Reliability of Content
Home Bill does not guarantee the accuracy, reliability, or completeness of any information provided through the platform, including any promotions, advertisements, or content from third-party providers. You agree to use the platform at your own risk and to independently verify any information before relying on it.

9.10. Limitation of Liability
To the fullest extent permitted by law, Home Bill disclaims all warranties, whether express or implied, and shall not be held responsible for any direct, indirect, incidental, consequential, special, or punitive damages, or any loss of profit, revenue, business, or data arising from the use or inability to use the Home Bill platforms, or from any third-party services accessed via the platform. This includes any damages resulting from service interruptions, errors, data breaches, or any other type of harm.

9.11. No Warranty for Continuous Access to Third-Party Content
Home Bill does not control or guarantee continuous access to any third-party content that is made available on the platform, including telecommunications services, digital products, or advertising services. We are not responsible for any disruption in access to such content or services that may occur for reasons beyond our control.

9.12. Service Modifications
Home Bill reserves the right to modify, suspend, or discontinue any part of the platform or its services at any time without notice. This includes the removal or alteration of any content, products, services, or features. We are not liable for any losses or damages caused by such changes or discontinuations.

10.1. Ownership; Proprietary Rights:

All content, features, and functionality available on the Home Bill Platforms, including but not limited to text, graphics, logos, images, videos, software, and data, are owned by or licensed to Home Bill Corporation Private Limited and are protected by intellectual property laws. You may not copy, reproduce, distribute, transmit, display, or create derivative works of any materials from Home Bill Platforms without prior written permission from Home Bill. All rights not expressly granted to you in these Terms and Conditions are reserved by Home Bill.

10.2. Arbitration:

Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, or the use of the Home Bill Platforms, shall be resolved by binding arbitration, rather than in court. The arbitration will be conducted in [Location] under the rules of [Arbitration Body]. You and Home Bill agree that any arbitration will be conducted on an individual basis and not as part of a class action. The arbitrator’s decision will be final and binding.

You may not assign or transfer any of your rights or obligations under these Terms and Conditions without prior written consent from Home Bill.

10.6. Changes to the Terms and Conditions:

Home Bill reserves the right to modify, update, or amend these Terms and Conditions at any time, in our sole discretion, without prior notice to you. Any changes will be effective and deemed accepted by you 24 hours after the initial posting on the Home Bill Platforms. The updated Terms and Conditions shall apply immediately on a going-forward basis, specifically with respect to any payment transactions initiated after the posting date.While Home Bill may make reasonable efforts to notify you of significant changes via email or through notifications on the Home Bill Platforms, it is your responsibility to regularly review the Terms and Conditions for any updates. By continuing to use the Home Bill Platforms after the changes have been posted, you agree to be bound by the modified Terms and Conditions. If you do not agree with the updated terms, you must discontinue your use of the Home Bill Platforms immediately.
